ADEM Updates

The Board of the Alabama Chapter of SWANA was notified today that in December of this year permit fees for environmental permits will increase by 19%. According to the Alabama Department of Environmental Management(ADEM), the increase is necessary to partially offset the 32% cut to its State general fund budget for FY 2012 which begins October 1,2011. The last permit fee increase was effective January 2008. Typical 5-year initial issuance permits for landfills will increase by the following amount: MSW -$7,440; C&D -$635; and Industrial-$1,125. In addition, initial geological reviews will increase by $430.

ADEM indicates even after the increase, permit fees in Alabama will continue to be the lowest in the nation. Permit fees represent about 60% of ADEM's cost of issuing the permit.We are getting this information out to you now so you will be able to reflect the increase in your budgeting process. Legislative Coal and Moratorium Updates

Coal ash

Act 2011-258 signed on 05 May 2011, removed an existing exemption from regulation as a solid waste for fly ash waste, bottom ash waste, boiler slag waste, and flue gas emission control wastes which result primarily from the combustion of coal or other fossil fuels at electric generating plants. Alabama was the only State in the U.S. to have such an exemption. ADEM is currently drafting the appropriate changes to its Solid Waste regulations necessary as a result of the law.

Moratorium

Act 2011-297 signed on 24 May 2011, places a 24-month moratorium on the issuance of permits to new, public solid waste landfills by ADEM for proposed facilities with a capacity of greater than 1,500 tons or 2,000 cubic yards per day, an area of more than 500 acres, aggregate capacities or areas of new or existing landfills within the same county or within a 20 mile radius of the new site, or a proposed capacity of more than that reasonable anticipated by the local solid waste management plan (SWMP) for the communities located within the same county or within 20 miles of the facility site. In addition, this law charges ADEM with working with the Department of Public Health (ADPH) to address the scope of ADEM's and ADPH's responsibilities under the Solid Wastes and Recyclable Materials Management Act (SWRMMA) and more specifically, to evaluate the current requirements for the permitting of new, solid waste landfills in Alabama.


ADEM continues to investigate scrap tire and unauthorized solid waste dump sites throughout the State. When the property owner is determined to be an "innocent landowner" by the Department, the cleanup of the site is eligible for funding under either the Scrap Tire Fund or the Solid Waste Fund, depending on the contents of the dump site.

In FY10, we completed twenty-eight small scrap tire site remediation projects removing nearly 60,000 passenger tire equivalents. The remediation costs associated with these projects were $382,727.71. To date in FY11, there are twenty-one small scrap tire site remediation projects. Seventeen projects have been competitively bid, and four projects are in progress. The remediation costs for the seventeen projects underway are approximately $267,600.00. Of the eight completed remediation projects, contractors have removed and disposed of approximately 28,000 passenger tire equivalents. The remaining four projects are slated for cleanup later this year. The Department continues to oversee the remediation activities of HDH General Contractors/Verdant at the third large scrap tire site remediation project located near Geneva, Alabama, with an estimated one million scrap tires. The contractor anticipates completing the project by the end of September. In July 2011, the fourth large scrap tire site remediation project was completed by C W Owens Enterprises at a cost of approximately $86,000 and nearly 70,000 passenger tire equivalents removed and disposed.

The regulations governing the cleanup of unauthorized dumps were approved in June 2009, which established a priority ranking system. There are currently 80 unauthorized dump sites ranked for remediation. Since the solid waste dump site remediation program's inception, the Department has issued entered into contracts for the cleanup of 191 sites. The total Solid Waste Fund monies committed since the program's inception is $3,851,491.58 for 136 remediation projects (remediation projects may include multiple dump sites).
